Website Design Agreement

This Website Design Agreement (“Agreement”) is between Enterprise Web Designs, owned and operated by Elias Loubani in Palm Harbor, Florida (“we” or “us”), and , located at , represented by , (“you”).

1. The project

We’ll design and build a website for your business using the package, which includes:.

  • Home, About and Contact pages
  • A design that works on phones, tablets and computers
  • A contact form and tap-to-call button
  • Google Maps location and business hours
  • SEO setup so search engines can find your site
  • Launch on your own domain
  • Up to 7 custom pages in total
  • A custom design built around your brand
  • Quote request and lead capture forms
  • Google Business Profile setup
  • A reviews and testimonials section
  • Help writing the words on every page
  • Visitor analytics
  • Up to 15 custom pages in total
  • Online booking and scheduling
  • A blog or news section
  • Client portal, carrier and quote links
  • Local SEO for every area you serve
  • A logo refresh or brand style guide
  • 30 days of priority edits after launch
  • Customer service for life, as described in section 6

2. Price and payment

  • Project price: , plus the additional items listed in section 1 at the prices in your written quote.
  • Deposit: 50% () is due when you sign. Work starts once we receive it.
  • Balance: the remaining is due when your site is finished, before it goes live.
  • We’ll send invoices by email. Prices don’t include any taxes that may apply.
  • Some features rely on outside services that charge their own fees, such as your domain name, hosting if you don’t choose a care plan, booking tools or paid plugins. We’ll tell you about any such cost before setting it up, and you’ll pay those fees directly to the provider.

3. What we need from you

  • Your text, photos, logo and other materials, plus any logins we need, as soon as you can. Your timeline depends on it.
  • Feedback and approvals when we ask for them, ideally within a week.
  • You confirm that you have the right to use everything you give us.
  • If we’re waiting on you for more than 30 days, we may pause your project. If it stays paused for another 60 days, we may close it, and your deposit covers the work done.

4. Revisions and changes

  • Your package includes up to 2 rounds of revisions to the design before launch.
  • Anything beyond your package or those revisions, such as extra pages, new features or a redesign, will be quoted in writing first, and we’ll only do it after you approve. Email counts as writing.

5. Review and launch

When your site is ready, we’ll send it to you to review. Once you approve it and pay the balance, we’ll launch it. Your domain will be registered in your name.

6. After launch

  • We’ll fix any errors in our own work that you report within 30 days after launch, at no charge.
  • Customer service for life: for as long as Enterprise Web Designs is in business, we’ll answer your questions and help with problems on the website we built for you, by phone or email, at no charge. This doesn’t include new features, new pages, redesigns, new content or hosting, or fixing problems caused by changes made by someone else. Those are quoted separately or covered by a care plan.
  • Without a care plan, you’re responsible for your own hosting, renewals and updates after launch. We’ll help you set up a hosting account in your name before launch.

7. Monthly care plan

You haven’t chosen a care plan. You can add one anytime by asking us. Its terms will be the same as those below.

  • It includes hosting, SSL security, backups and uptime monitoring.
  • It includes everything in Basic Care (hosting, SSL security, backups and uptime monitoring), plus up to 1 hour of edits each month and a monthly report. Unused edit time doesn’t carry over to the next month.
  • A care plan starts when your site launches and is billed monthly, in advance.
  • It renews automatically each month until you cancel. You can cancel anytime by phone or email, with no cancellation fee. It stays active until the end of the month you’ve paid for, and partial months aren’t refunded.
  • We’ll give you at least 30 days’ notice before changing the price.
  • If you cancel, we’ll help you move your site to a hosting account in your name.

8. Ownership

  • Once you’ve paid in full, you own your finished website: its design, the content we create for you and the site files. We’ll hand over every login.
  • Some parts of a website come from other companies, such as fonts, stock photos, plugins or booking tools. Those stay owned by their creators and are licensed for your site under their own terms.
  • We keep ownership of the general tools, code and know-how we use across projects, and you get a permanent license to use them as part of your website.
  • Until you’ve paid in full, we keep ownership of the work.
  • We may show your finished website in our portfolio and marketing.
  • You’ve asked us not to feature your website in our portfolio or marketing, and we won’t.

9. Results

We build your site using good SEO and Google Business Profile practices, but no one controls Google, ChatGPT or other search and AI tools. We don’t guarantee any ranking, traffic, calls or sales.

10. Privacy and logins

We’ll keep your private business information and logins confidential and use them only for your project. You’re welcome to change your passwords once the project is done. You’ll keep anything private you learn about our business confidential too.

11. Cancelling

  • You can cancel this Agreement anytime by telling us in writing. If you cancel before we start work, we’ll refund your deposit in full. Once work has started, your deposit isn’t refundable, because it pays for work already done.
  • We can end this Agreement if you don’t pay or don’t follow it, after giving you written notice and 10 days to fix the problem.
  • If this Agreement ends early, you’ll receive the work completed so far that you’ve paid for.

12. Responsibility

  • We’ll do our work carefully and professionally. Beyond what this Agreement says, and as far as the law allows, we don’t make any other warranties.
  • Neither of us is responsible to the other for indirect losses, such as lost profits, lost data or business interruption. Our total responsibility under this Agreement is limited to the amount you’ve paid us under it.
  • Each of us will cover the costs of any claim caused by materials we provided for your website.
  • Neither of us is responsible for delays caused by events outside our control, such as hurricanes, power or internet outages, or problems with outside services.

13. General

  • We’re an independent business, not your employee, and we may work with other clients.
  • This Agreement, together with your written quote, is the entire agreement between us. Any change must be in writing, and email counts. If any part can’t be enforced, the rest still applies.
  • Florida law applies. If a disagreement can’t be resolved by talking it through, it will be handled in the state or federal courts serving Pinellas County, Florida, and whoever wins can recover reasonable attorney’s fees.

  • We both agree that electronic signatures and records are as valid as paper ones. You can ask us for a paper copy at any time.
  • This Agreement takes effect when you sign it. We accept it when we receive your deposit.
