About these terms

These terms cover your use of this website and the website design and care services offered by Enterprise Web Designs (“we” or “us”). Enterprise Web Designs is owned and operated by Elias Loubani in Palm Harbor, Florida. By using this website or hiring us, you agree to these terms.

When we take on a project, we’ll also give you a written quote or agreement. If it says something different from these terms, the written quote or agreement wins.

Using this website

Information on this site

The information on this website is a general description of our services. We work to keep it accurate, including prices, but we may update our services and prices at any time. The price you pay is the one in your written quote. Images on this site are for illustration and don’t show specific client projects.

Our content

This website’s design, text, graphics, logo and code belong to Enterprise Web Designs or the people who license them to us. Please don’t copy or reuse them without our written permission. “Enterprise Web Designs” and our logo are our trademarks.

Fair use of the site

Don’t misuse this website. For example, don’t try to break into it, overload it, send spam through the form, or copy it with automated tools.

Website design projects

Quotes and payment

Every project starts with a written quote that lists what’s included and the price. We begin work once you approve the quote and pay a 50% deposit. The rest is due when your site is finished, before it goes live.

Timelines

Timelines on this website, such as “ready in about 1 week,” are estimates. They depend on receiving your content, feedback and approvals on time.

Your content

You’re responsible for the text, photos, logos and other materials you give us, and you confirm that you have the right to use them. If someone makes a claim against us because of materials you provided, you agree to cover the costs of that claim.

Changes and extra work

Your package includes the work listed in your quote. Anything beyond that, like extra pages, new features or a redesign, will be quoted separately before we do it.

Cancelling a project

You can cancel a project at any time by telling us in writing. If you cancel before we start work, we’ll refund your deposit in full. Once work has started, the deposit isn’t refundable, because it pays for work already done.

Who owns the website

Once you’ve paid in full, you own your finished website: its design, the content we create for you and the site files. Your domain is registered in your name, and we’ll hand over every login.

Some parts of a website come from other companies, such as fonts, stock photos, plugins or booking tools. Those stay owned by their creators and are licensed for your site under their own terms. Until your project is paid in full, we keep ownership of the work.

We may show your finished site in our portfolio and marketing. Just tell us if you’d rather we didn’t.

Outside services

Websites depend on outside services, such as hosting companies, domain registrars, Google, and form or booking tools. Those services have their own terms and fees, and we aren’t responsible for their outages, changes or decisions.

Search and AI results

We set up your site using good SEO and Google Business Profile practices, but no one controls Google, ChatGPT or other search and AI tools. We can’t guarantee any ranking, traffic, calls or sales.

Customer service for life (Premium)

For Premium clients, “customer service for life” means that, for as long as Enterprise Web Designs is in business, we’ll answer your questions and help with problems on the website we built for you, by phone or email, at no charge. It doesn’t include new features, new pages, redesigns, new content or hosting. It also doesn’t cover fixing problems caused by changes made by someone else. Those are quoted separately or covered by a care plan.

Monthly care plans

Billing and renewal

Care plans are billed monthly, in advance, at the price in your quote. Your plan renews automatically each month until you cancel.

Cancel anytime

You can cancel anytime by phone or email, with no cancellation fee. Your plan stays active until the end of the month you’ve already paid for, and partial months aren’t refunded. If your site is hosted on our plan, we’ll help you move it to a hosting account in your name.

Included edit time

Growth Care includes up to 1 hour of edits each month. Unused time doesn’t carry over to the next month.

Price changes

We’ll give you at least 30 days’ notice before changing the price of your care plan.

Legal details

Warranties

We’ll do our work carefully and professionally. Beyond that, and as far as the law allows, this website and our services are provided “as is,” without other warranties.

Limit on liability

As far as the law allows, we aren’t responsible for indirect or consequential losses, such as lost profits, lost data or business interruption. Our total responsibility for any claim related to our services is limited to the amount you paid us for those services in the 12 months before the claim. Nothing in these terms limits responsibility that can’t be limited by law.

Disagreements

If something goes wrong, please contact us first and we’ll work to make it right. These terms are governed by the laws of the State of Florida. Any legal dispute will be handled in the state or federal courts serving Pinellas County, Florida.

Changes to these terms

We may update these terms. We’ll post the new version here with a new effective date. Projects already under way follow the terms that were in place when you approved your quote, unless we both agree otherwise.
